REAL PROPERTY SALE - ATTORNEY INSTRUCTIONS





WHAT WE NEED FROM THE ATTORNEY TO GET STARTED

 

1.  Instructions to Sheriff (ORS 18.875), including whether to post the notice of sale on the Oregon State Sheriff ‘s Association (OSSA) website or the newspaper of general circulation (ORS 18.924) Go here for more information on posting on the OSSA website
2.  Writ of Execution (must be the signed original)
3.  Copy of the Judgment
4.  $70.00 fee for Writ (made payable to the Deschutes County Sheriff's Office) (an invoice for other fees/costs will be mailed after the sale)
5.  Order Authorizing Sale (if needed per ORS 18.904)

Note: If these items are not complete, we will not process and schedule the sale until we have all items. This may mean we will ask for the plaintiff to extend the writ to 150 days.

IMPORTANT NOTICE:

On July 1, 2014, the Deschutes County Sheriff’s Office will be changing the fee calculation for Sheriff’s foreclosure sales from actual cost of services to the folio structure based on the formula in ORS 21.300 (1)(d). The Deschutes County Commissioners approved this fee change in April 2014.

The reason behind the change is the increase in the number of foreclosure sales over the last three years. In 2012 the Sheriff’s Office had 120 sales. In 2013 we processed 337 sales. If the current pace for 2014 continues we will have over 500 sales. The Sheriff’s Office is not able to add sufficient staff in response to this increase.

A folio fee structure will increase efficiency because Sheriff’s Office staff will no longer spend time tracking actual time processing the file. In addition, we will be able to provide total Sheriff’s costs at the beginning of the process.

In cases with more than four mailings, the total of the fees will be higher under the folio fee structure than under the past actual cost of services fees. Cases with four or fewer mailings will be close to the amount previously charged under actual costs of service. For example, four mailings might be a combination of one debtor, first class and certified mail, and two other parties entitled to notice by first class mail.

This folio fee structure is similar to the fee calculation used by the Marion County Sheriff’s Office for their foreclosure sales.

Also, the Sheriff’s Office will be charging $10.00 for each notarized document associated with sheriff’s sales.

The fee for posting the notice of sale for real property on the OSSA website is $250.00.  Up to four photos can be posted for an additional $50.00. The check for these fees can be made payable to OSSA and can be submitted with the Writ of Execution to our office.

1) Needs to be submitted no less than 48 hours prior to sale date
2) If you do not submit written credit bid, then you must show up at the sale
